Violations, Restoration & Monitoring
No one plans on having a wetland or shoreland violation. Most of our Clients (with violations) contact us after
receiving a letter from their Town or the NHDES Wetlands or Shoreland Bureaus informing them that they may
have a violation. In some cases they also receive a cease & desist order to stop all work until the issues are
resolved. Having a violation can be very stressful and costly, especially if you have construction equipment
sitting idle on your project. If you have (or are concerned you may have) a wetland or shoreland violation it is
imperative that you contacts us as soon as possible. This allows more time to evaluate the situation, discuss
options, and meet with regulatory agencies before any penalties or fines can be issued for non-compliance. While
our Clients are always involved in the process, we can make the process much less stressful for you by acting as
your agent on the project. This means all calls from the regulatory agencies, including technical questions or legal
correspondence will be directed to our office. You will receive copies of everything, but we will track timeframe
requirements, answer any technical questions, meet with regulatory officials, etc. We always have our Clients
best interest in mind, and will work with the regulatory agencies to find a solution that will be acceptable to all
parties.
While many violations can be resolved by filing an after-the-fact application to obtain a permit, some impacted
wetlands or shoreland areas will need to be restored. If this becomes necessary, we can put together a restoration
plan that will bring your project back into compliance. Sometimes this is as simple as planting some shrubs or
saplings, but in other cases we may need to design some major modifications to the site.
Once the restoration and/or permits have been approved you will have a certain amount of time to complete the
work. We will go over the approval forms with you, answer any questions you may have about the process, and
monitor the completion of your project. Once all site work is complete, we will notify all regulatory agencies
involved. If your project requires additional monitoring (usually required by NHDES for restorations) we will
inspect the property per state and federal guidelines, to make sure your project remains in compliance.
